Terms of Service

These terms are the agreement between you and Cardra LLC (“Cardra”, “we”, “us”), an Arizona limited liability company at 4539 N 22nd St Ste R, Phoenix, AZ 85016, United States. They cover the Cardra mobile app and cardratcg.com (the “Service”). By creating an account or using the Service, you agree to them.

Two things worth knowing up front. Card prices in Cardra are estimates from third-party market data, not appraisals or financial advice. And subscriptions are billed by Apple or Google, so cancellations and refunds are handled in your store account, not by us.

1. Who can use Cardra

You must be at least 13 years old to have a Cardra account. If you are under the age of majority where you live, you must have a parent or guardian's permission. You agree to give accurate account information and to keep it up to date, and you are responsible for what happens under your account, including keeping your password secure. Tell us promptly at cardra@cardratcg.com if you think someone else is using your account.

2. What the Service does

Cardra lets you scan trading cards with your device camera, identify them, keep a collection, and see estimated market values.

Scanning is not perfect

Card identification uses automated text recognition and matching. It can misread a card or suggest the wrong one, especially with damage, glare, sleeves, or unusual printings. You are responsible for checking that a saved card is the right one. The app shows alternatives when it isn't confident, and lets you correct a match afterwards.

Prices are estimates

Prices and collection totals come from third-party market data, are refreshed periodically, and may be out of date, incomplete, or wrong. They are estimates for your own reference, not appraisals, offers, or financial or investment advice. Don't rely on them for buying, selling, insuring, or reporting the value of anything. We are not responsible for decisions you make based on them.

3. Free accounts and Cardra Pro

Free

A free account can save a limited number of cards (currently 30 for the lifetime of the account). We may change that limit; if we reduce it, cards you have already saved stay in your collection.

Subscription

Cardra Pro removes the save limit. It is offered as a monthly or annual subscription at the prices shown in the app, which vary by country and may change.

4. Your content and your data

Your collection data is yours. You grant us only the permission needed to run the Service: to store, process and display that data back to you, and to keep the anonymized scan records described in our Privacy Policy so we can measure and improve scanning accuracy.

If you send us feedback or suggestions, we may use them to improve Cardra without owing you anything for them.

You can export your collection to CSV at any time, and delete your account and its data from Profile → Delete account.

5. Acceptable use

Don't:

We may limit, suspend, or close accounts that break these rules or put the Service or other users at risk.

6. Card names, images and third-party rights

Cardra shows card names, images, set details and market prices from third-party sources for identification and cataloging. Those names, images and logos belong to their owners.

Cardra is an independent app and is not affiliated with, endorsed, sponsored, or approved by Nintendo, The Pokémon Company, The Pokémon Company International, Game Freak, Creatures Inc., Shueisha, Toei Animation, or Bandai. Pokémon, One Piece, and related names are trademarks of their respective owners.

If you own rights in content shown in Cardra and believe it's being used improperly, email cardra@cardratcg.com with the details and we'll respond promptly.

Everything else in the Service — the app, the website, our name and logo, and our own text and design — belongs to Cardra LLC. You may use it only as these terms allow.

7. Your licence to use the app

We grant you a personal, revocable, non-exclusive, non-transferable licence to install and use the Cardra app on devices you own or control, for your own non-commercial use, subject to these terms and to the rules of the store you installed it from.

If you installed from the App Store

These terms are between you and Cardra LLC, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims, or for third-party claims that the app infringes intellectual property rights. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

8. Availability and changes

We may change, suspend, or discontinue any part of the Service, and we may add or remove supported card games or features. We aim to keep the Service running but don't guarantee it will always be available or error-free, and we may take it down for maintenance. We are not liable for interruptions, or for data that a third-party price or card-data source stops providing.

9. Ending your access

You can stop using Cardra at any time and delete your account in the app. We may suspend or terminate your access if you break these terms, if we're required to by law, or if we discontinue the Service. If we close your account without cause and you have paid for a subscription period, contact us and we'll help you seek a refund for the unused part through your store.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CARD IDENTIFICATION, PRICING DATA, OR COLLECTION VALUES ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDRA LLC AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSSES ARISING FROM DECISIONS MADE USING PRICE ESTIMATES OR CARD IDENTIFICATIONS SHOWN IN THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) US$50.

Some jurisdictions don't allow these limitations, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law.

12. Indemnification

You agree to defend and indemnify Cardra LLC against claims, losses and reasonable legal fees arising from your use of the Service, your breach of these terms, or your violation of someone else's rights. We'll tell you about any such claim and may take over its defense at our own expense.

13. Governing law and disputes

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law rules.

Talk to us first

If there's a dispute, email cardra@cardratcg.com first. Most problems can be sorted out quickly. Both sides agree to try to resolve it informally for at least 30 days before starting formal proceedings.

Arbitration and class waiver

If we can't resolve it informally, disputes will be settled by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, seated in Maricopa County, Arizona, or conducted remotely. You and Cardra each waive the right to a jury trial and to participate in a class action. Either of us may instead bring an individual claim in small-claims court, and either of us may seek an injunction in court to protect intellectual property or stop unauthorized use. If the class waiver is found unenforceable, the arbitration agreement does not apply to that claim.

Nothing here removes any right you have under the consumer laws of your own country that cannot be waived by agreement.

14. Privacy

Our Privacy Policy explains what we collect and why, and is part of these terms. The Service is hosted in the United States; if you use it from elsewhere, your information is transferred there.

15. Changes to these terms

We may update these terms as Cardra changes. We'll update the date at the top, and for significant changes we'll notify you in the app or by email. Continuing to use the Service after a change means you accept the updated terms.

16. Other terms

If any part of these terms is unenforceable, the rest still applies. Our not enforcing a term isn't a waiver of it. You may not transfer these terms to someone else; we may transfer them as part of a sale or reorganization of our business. These terms, together with the Privacy Policy, are the entire agreement between you and Cardra about the Service.
